Not condoning the dafty that ran on last night. but can someone who knows these things tell me . how can you assault someone by attempting and failing to assault them.

Because in Scots law an Assault is defined as any attack directed to take effect on the body of another, whether or not injury is inflicted. There is no such thing as an attempted assault.
